What Is Spousal Support?

Spousal support refers to the financial support provided to a spouse during separation. If you are a dependant spouse, you may be able to collect spousal support until your divorce is finalized. If you are the breadwinner, you may need to take action to avoid unrealistic support obligations.

What Is Alimony?

Alimony is a payment made after the final divorce decree. Alimony can be decided by a court, agreed to in negotiations, or determined in a postnuptial or marital settlement agreement. We think court should be a last resort in many divorce and family law cases.

Alimony calculations are usually based on a variety of factors, including the incomes and earning capacities of the parties, the standard of living established during the marriage, length of the marriage, the property owned by each party, and the age and health of the parties and other considerations.

What Is Alimony Pendente Lite (APL)?

This is a form of spousal support that one party can receive after the filing of the divorce complaint and prior to the issuance of a final divorce decree by the court. It is awarded when there is a variance in earning capacities. It serves to put both parties on an equal playing field regarding divorce litigation. The fault has no bearing on the issuance of this form of support.

Can I Get a Modification of Alimony?

If you have undergone a change in circumstances such as an injury or job loss, you may be able to seek a modification to increase payments of alimony or to decrease your obligations. Our legal team has experience in modification cases and will provide you with the information you need to pursue an adjustment or defend your rights in a modification situation. We will also prepare the documentation and provide the advocacy you need to get results in court.
